1. Agreement to Terms
By accessing or using ArtistCal ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
2. Description of Service
ArtistCal is a mobile application and web-based platform that provides appointment scheduling, business management, and related services for tattoo studios and artists. The Service includes:
- Appointment scheduling and management
- Client and employee management
- Financial tracking and reporting
- Online booking pages for customers
- SMS and email notifications
- Other features as described in the application
3. Account Registration and Security
3.1 Account Creation
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and identification
- Accept all responsibility for activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to comply with this section.
4. Subscription and Payment Terms
4.1 Free Trial
We offer a 7-day free trial for new users. During the trial period, you have full access to the Service. No credit card is required to start the trial.
4.2 Subscription Plans
After the trial period, you must subscribe to a paid plan to continue using the Service. Subscription plans are available on a monthly or annual basis, as described on our pricing page.
4.3 Payment
- Payments are processed through third-party payment processors (e.g., Paddle)
- Subscription fees are billed in advance on a recurring basis
- All fees are non-refundable except as required by law
- You authorize us to charge your payment method for all applicable fees
- If payment fails, we may suspend or terminate your access to the Service
4.4 Cancellation
You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of the billing period.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Violate or infringe upon the rights of others, including intellectual property rights
- Transmit any harmful code, viruses, or malicious software
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers
- Use automated systems to access the Service without permission
- Impersonate any person or entity or misrepresent your affiliation
- Collect or harvest information about other users without consent
- Use the Service to send spam, unsolicited messages, or harass others
6. User Content and Data
6.1 Your Content
You retain ownership of all content and data you upload or create using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to use, store, and process your User Content solely for the purpose of providing and improving the Service.
6.2 Content Responsibility
You are solely responsible for your User Content and warrant that:
- You have the right to use and share the content
- The content does not violate any laws or third-party rights
- The content is accurate and not misleading
6.3 Data Backup
While we implement backup and recovery measures, you are responsible for maintaining backups of your important data. We are not liable for any loss of data.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by ArtistCal and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of the Service, unless laws prohibit these restrictions or you have our written permission.
8. Service Availability and Modifications
We strive to provide reliable service but do not guarantee that the Service will be available at all times or free from errors. We reserve the right to:
- Modify, suspend, or discontinue the Service at any time
- Perform maintenance that may temporarily interrupt service
- Update features, functionality, or user interface
- Change pricing with reasonable notice
9. Termination
9.1 Termination by You
You may terminate your account at any time by deleting your account through the Service or contacting customer support.
9.2 Termination by Us
We may suspend or terminate your access to the Service immediately, without prior notice, if you:
- Violate these Terms or our policies
- Engage in fraudulent, illegal, or harmful activities
- Fail to pay subscription fees
- Use the Service in a manner that could harm us or other users
9.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.
10. Disclaimers and Limitation of Liability
10.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTISTCAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
10.3 Maximum Liability
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless ArtistCal and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ArtistCal operates, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending an email notification (for significant changes)
Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
